In consideration for being permitted to participate in the ROCKY MAN 70.3 triathlon event (“Event”), including all related activities such as swimming, cycling, running, warm-ups, transitions, travel, volunteering, and use of facilities or equipment, I acknowledge and agree to the following:
1. Assumption of Risk
Participation in a triathlon and related activities involves inherent and significant risks, including but not limited to: drowning or near drowning; collisions with vehicles, bicycles, pedestrians, or other participants; falls, crashes, or loss of control; hazardous road, trail, or water conditions; weather-related dangers including heat, cold, lightning, and dehydration; equipment failure; negligent acts of other participants or spectators; and serious bodily injury, permanent disability, paralysis, or death. I knowingly and voluntarily assume all risks, known and unknown, associated with participation in the Event.
2. Health and Fitness
I certify that I am physically fit, adequately trained, and capable of safely participating in the Event. I have no medical condition that would make participation unsafe. I understand that emergency medical services may be limited or delayed.
3. Release and Waiver of Liability
To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue the Event organizers, hosts, volunteers, sponsors, property owners, municipalities, timing companies, and all related individuals and entities (“Released Parties”) from any and all claims, liabilities, demands, damages, causes of action, or expenses arising from or related to my participation in the Event, including claims arising from ordinary negligence of the Released Parties.
4. Indemnification
I agree to indemnify and hold harmless the Released Parties from any claims, damages, liabilities, costs, or attorney fees arising from my participation in the Event or my actions during the Event.
5. Rules and Safety
I agree to follow all Event rules, safety instructions, and directions from organizers and volunteers. I understand that organizers may remove me from the Event if my participation poses a safety risk. ANSI- or CPSC-approved bicycle helmets must be worn at all times while riding. Portions of the cycling and running courses may occur on open roads or shared-use paths. Water conditions may include cold temperatures, currents, limited visibility, or other hazards. Weather or course conditions may require modification, delay, or cancellation of the Event.
6. Medical Treatment Authorization
I authorize Event personnel and emergency medical providers to obtain medical treatment for me if necessary during the Event. I understand that I am responsible for any resulting medical costs.
7. Photography and Media Release
I grant permission for Event organizers to use photographs, video, or audio recordings of me taken during the Event for promotional, social media, or other lawful purposes without compensation.
8. No Refunds
Registration fees, if any, are non-refundable except at the sole discretion of the organizers.
9. Severability
If any portion of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
10. Acknowledgment
I have carefully read this Waiver and Release of Liability, fully understand its contents, and sign it voluntarily. I understand that I am giving up substantial legal rights by signing this document.
